Non-solicitation or non-compete – don’t get it twisted

In this episode, Linnéa Ceréus and William Bådagård take a closer look at non‑solicitation and non‑compete clauses in employment contracts, in light of the Swedish Labour Court’s decision AD 2026 no. 23.

They discuss the respective interests of employers and employees when the parties part ways and note that a clause restricting an employee from soliciting the former employer’s customers does not constitute a non‑compete clause within the meaning of the 2015 agreement on the use of non‑compete clauses in employment contracts – regardless of how anti-competitive it may appear.
