
What is a design right?

Design rights are a form of intellectual property protection that safeguard the appearance of a product. In other words, design rights do not provide protection for technical solutions, such as those covered by patents or utility models. Regulations governing design rights vary somewhat from country to country.
For example, under the European Union Design Regulation, the subject matter of a design, the “product”, refers to any industrially or artisianally manufactured item, regardless of whether it is embodied in a physical object or exists in a non-physical form. This means that, for example, product packaging, graphic works, symbols, logos, and surface patterns can also be protected by design rights.
Design rights may cover the overall appearance of a product or only a part of its appearance. Features of a product, such as its lines, contours, colors, shape, surface texture, and materials, may be eligible for design protection. Following the European Union’s recent design reform, movement, transition, or other animation of the aforementioned protectable features may also be eligible for design protection as an EU-wide EU design.
It is worth noting for many stakeholders that computer programs as such are excluded from the scope of design protection. Graphical user interfaces, which are often associated with computer programs, are, however, eligible for design protection. Computer programs may receive intellectual property protection under copyright law.
Why is design protection important?
Design rights are an important form of protection in all fields where new designs are developed, whether the creations are physical products or graphical user interfaces. By protecting new creations with design rights, a company increases both the value of its brand and its competitive advantage. Design registration enables a company to take action against the copying and imitation of its design, which is often impossible or at least extremely difficult without such registration.
A good starting point for assessing the need for design protection for a new product is to consider to what extent copying the design by a third party would harm business operations or otherwise negatively impact the designer. Another useful perspective on design protection is to view it as a preventive safeguard, much like a firewall: appropriate design protection can significantly reduce third parties’ willingness and ability to infringe the design.
Design application and registration
Design registration is available for designs that are new and of individual character. In practice, “novelty” in this context means that the product covered by the design right has not been disclosed to parties outside the circle of the design’s creators (excluding certain special cases) prior to the filing of the design application. A design is considered individual when the overall impression it conveys differs, in the eyes of an informed user, from other previously published designs.
Design rights can be applied for nationally, in which case the design registration is valid in the country to which the application is directed, or, for example, as an EU wide EU design, in which case the design registration is valid uniformly in all EU countries. In certain situations, it may also make sense to utilize the so-called international design system (the Hague System), in which a design application is filed centrally through the World Intellectual Property Organization (WIPO), from where the application is forwarded to the offices of the designated countries listed in the application. The local offices then process the applications in accordance with their respective national practices. In certain situations, this application route offers cost savings on application and renewal fees while also opening other strategic opportunities.
High-quality, accurate images of the design to be protected are central to a design application. The images are important because the protection for the design covers only what is visible in the images. Typically, images of a design are presented as line drawings, but color or grayscale 3D images or photographs are also acceptable, provided they are presented against a neutral background.
The term of protection for an EU design and a Finnish national design is five years from the date of filing the application. However, the registration may be renewed four times for five-year periods upon payment of a renewal fee, in which case the protection may remain in effect for a total of up to 25 years. Mitä mallioikeus tarkoittaa?
Mallioikeus on immateriaalioikeudellinen suojamuoto, joka suojaa tuotteen ulkomuotoa. Toisin sanoen mallioikeus ei anna suojaa esimerkiksi teknisille ratkaisuille, kuten patentit tai hyödyllisyysmallit. Mallioikeuksia koskevat säännökset vaihtelevat jonkin verran maakohtaisesti.
Esimerkiksi Euroopan Unionin mallioikeusasetuksessa mallin kohteella eli “tuotteella” tarkoitetaan mitä tahansa teollisesti tai käsityönä valmistettua tavaraa riippumatta siitä, sisältyykö se fyysiseen esineeseen vai ilmeneekö se muussa kuin fyysisessä muodossa. Tämä tarkoittaa sitä, että myös esimerkiksi tuotteiden pakkaukset, graafiset teokset tai symbolit, logot ja pintakuviot voidaan suojata mallioikeudella.
Mallioikeuden kohteena voi olla tuotteen ulkomuoto kokonaisuudessaan tai ainoastaan osa tuotteen ulkomuodosta. Mallioikeussuojaa voivat saada tuotteen ominaisuudet, kuten sen linjat, ääriviivat, värit, muoto, pintarakenne ja materiaalit. Euroopan Unionin tuoreen mallioikeusuudistuksen myötä myös edellä mainittujen suojattavien ominaisuuksien liike, siirtymä tai muu animaatio voivat saada mallioikeussuojaa Euroopan Unionin laajuisena EU-mallina.
Monelle toimijalle huomionarvoista on, että tietokoneohjelmat itsessään ovat suljettu mallioikeuden suoja-alan ulkopuolelle. Tietokoneohjelmiin usein liittyvät graafiset käyttöliittymät ovat sen sijaan suojattavissa mallioikeudella, ja tietokoneohjelmat voivat saada immateriaalioikeudellista suojaa tekijänoikeuden perusteella.
Miksi mallioikeus on tärkeä?
Mallioikeus on tärkeä suojamuoto kaikilla aloilla, joilla kehitetään uutta muotoilua, olivatpa tuotokset sitten fyysisiä tuotteita tai graafisia käyttöliittymiä. Suojaamalla uudet tuotokset mallioikeudella kasvattaa yritys sekä brändinsä arvoa että kilpailuetuaan. Mallioikeusrekisteröinti mahdollistaa puuttumisen mallin kopiointiin ja jäljittelyyn, mikä ilman mallioikeusrekisteröintiä on usein mahdotonta tai vähintään erittäin hankalaa.
Hyvä lähtökohta uuden tuotteen mallioikeussuojan tarvetta arvioitaessa on pohtia, missä määrin mallin kopiointi kolmannen osapuolen toimesta haittaisi liiketoimintaa tai muuten vaikuttaisi negatiivisesti mallin luojan toimintaan. Toinen hyödyllinen näkökulma mallioikeussuojaan on sen hahmottaminen ennaltaehkäisevänä suojakeinona ikään kuin palomuurina: asianmukainen mallioikeussuoja voi jo sellaisenaan vähentää merkittävästi kolmansien osapuolten halua ja mahdollisuuksia loukata mallioikeutta.
Mallioikeushakemus ja -rekisteröinti
Mallioikeusrekisteröinti on mahdollista malleille, jotka ovat uusia ja luonteeltaan yksilöllisiä. Käytännössä uutuus tarkoittaa tässä yhteydessä sitä, että mallioikeuden kohteena olevaa tuotetta ei ole julkaistu mallin luojiin nähden ulkopuolisille tahoille (pois lukien tietyt erityistapaukset) ennen mallihakemuksen jättämistä. Yksilöllisenä mallia pidetään puolestaan silloin, kun mallista saatava yleisvaikutelma eroaa asiantuntevan käyttäjän silmissä muista aiemmin julkaistuista malleista.
Mallioikeutta voidaan hakea kansallisesti, jolloin mallioikeusrekisteröinti on voimassa siinä maassa, johon hakemus on kohdistettu, tai esimerkiksi edellä mainittuna Euroopan Union laajuisena EU-mallina, jolloin mallioikeusrekisteröinti on voimassa yhtenäisenä kaikissa EU-maissa. Tietyissä tilanteissa voi olla myös järkevää hyödyntää niin sanottua kansainvälistä mallijärjestelmää (Hague System), jossa mallioikeushakemus jätetään keskitetysti kansainvälisen immateriaalioikeusjärjestön (WIPO) kautta, josta hakemuksen käsittely kohdistetaan edelleen hakemuksella nimettyjen kohdemaiden virastoihin, jotka käsittelevät hakemukset kohdemaiden käytänteiden mukaisesti. Tämä hakuväylä tarjoaa tietyissä tilanteissa kustannussäästöjä hakemus- ja uudistuskuluissa sekä avaa samalla muita strategisia mahdollisuuksia.
Mallioikeushakemuksen keskiössä ovat hyvälaatuiset ja tarkat kuvat suojattavasta mallista. Kuvat ovat tärkeitä, koska mallin suoja kattaa vain sen, mitä kuvissa on näkyvissä. Tavanomaisesti mallin kuvat esitetään viivapiirroksina, mutta myös esimerkiksi värilliset tai harmaasävyiset 3D kuvat tai valokuvat käyvät, kunhan ne on esitetty neutraalia taustaa vasten.
EU-mallin ja suomalaisen kansallisen mallin suoja-aika on viisi vuotta mallin hakemispäivästä. Rekisteröinti voidaan kuitenkin uudistaa uudistusmaksua vastaan neljä kertaa viiden vuoden jaksoiksi, jolloin suoja voi olla voimassa yhteensä enintään 25 vuotta. Suoja-ajat ja mallihakemuksia koskevat vaatimukset vaihtelevat kuitenkin maittain.
